These Terms of Service (“Terms”) govern your use of the website and online store operated under the brand SOMBRA (“we”, “us”, “our”). By accessing our website or purchasing from us, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use our Services.

SOMBRA is operated by an individual entrepreneur (ENI) based in Portugal.

2. Eligibility

By using this website and placing an order, you confirm that:

  • You are at least 18 years old, or
  • You are accessing the Services under the supervision of a legal guardian.

We reserve the right to refuse service to anyone at our discretion.

3. Products

We sell jewellery made of:

  • Sterling silver
  • Stainless steel

Because our products are handcrafted, slight variations in shape, texture, colour, or finish may occur and are considered a natural characteristic of the product, not a defect.

Product images are for illustrative purposes. We make reasonable efforts to display products accurately, but we cannot guarantee that your device’s display reflects the true colour of the item.

4. Orders

By placing an order, you agree that:

  • All information you provide is accurate and complete
  • You are authorised to use the chosen payment method

We reserve the right to:

  • Refuse or cancel orders at our discretion
  • Limit quantities per customer or per address
  • Cancel orders in case of suspected fraud or pricing errors

You will receive an order confirmation by email.

5. Prices and Payments

All prices are shown in EUR (€) and include applicable taxes unless stated otherwise.

We accept the following payment methods:

  • Shopify Payments (credit/debit cards)
  • PayPal
  • MB Way via Eupago

Payments are processed securely by third-party providers. We do not store or have access to full payment card details.

6. Shipping

We dispatch orders from Portugal.

Estimated delivery times:

  • Portugal: 2–4 business days
  • Other European countries: delivery times vary depending on the destination

Shipping times are estimates and not guaranteed. We are not responsible for delays caused by postal services, customs, or force majeure events.

7. Returns & Refunds

You have the right to return your order within 30 days of receiving your items, in accordance with EU consumer law.

Conditions:

  • Items must be unused, unworn, and in their original packaging
  • Proof of purchase is required

We accept returns for all products, including earrings.

Customers are responsible for return shipping costs unless the item is defective or incorrect.

Refunds are processed using the original payment method after we receive and inspect the returned items.

8. Damage, Wear & Product Care

Normal wear and aging caused by regular use (scratches, oxidation, tarnishing, colour changes) are not considered defects.

We are not responsible for damage caused by:

  • Improper use
  • Accidents
  • Exposure to chemicals, perfumes, or water not suitable for jewellery
  • Physical impact or neglect

9. Intellectual Property

All content on this website, including but not limited to:

  • Images
  • Designs
  • Logos
  • Product descriptions

is the intellectual property of SOMBRA and may not be copied, reproduced, or used without prior written permission.

10. Limitation of Liability

To the fullest extent permitted by law, SOMBRA shall not be liable for:

  • Indirect or consequential damages
  • Loss of data, profits, or business opportunities

Our total liability shall not exceed the amount paid for the product in question.

12. Governing Law

These Terms are governed by and interpreted in accordance with the laws of Portugal and the European Union, without regard to conflict of law principles.
